SCHIP Bills Advance Before Congressional Recess

Congress this week advanced legislation affecting 2008 Medicare payments for physical therapists before adjourning for its August recess. The $90 billion "Children's Health and Medicare Protection (CHAMP) Act" (HR 3162), which adjusts Medicare payments and boosts funding for the State Children's Health Insurance Program (SCHIP), passed in the House Wednesday by a 225-to-204 vote. The Senate on Thursday approved a smaller SCHIP reauthorization bill, which does not include any Medicare provisions, by a 68-to-31 vote.

The House bill includes a 2-year extension of the Medicare therapy cap exceptions process and a 0.5% update in fee schedule payments through 2009, preventing a scheduled 9.9% cut.

HR 3162 also increases SCHIP funding by $50 billion over 5 years. The Senate measure provides a $35 billion increase to SCHIP. The two versions must be negotiated by members of both chambers in conference committees to reach a final agreement. Nevertheless, the president is threatening a veto.

The House legislation also could affect federal regulations released this week increasing payments to inpatient hospital services, inpatient rehabilitation facilities (IRFs) and skilled nursing facilities (SNFs) in fiscal year 2008. Final rules issued this week by the Centers for Medicare & Medicaid Services (CMS) provide funding increases of 3.5% under the hospital inpatient prospective payment system (IPPS), 3.2% for IRFs, and 3.3% for SNFs. The CHAMP Act, if approved, could lower the scheduled funding increases to offset other budget reforms.
